Regardless of what they failed to secure their AP does not give you the de facto right to access it. The test for unauthorized access to a computer network is if you were given specific permission to access it, which I hardly think this is the case (especially if you have no idea who's AP it is). Just because it's an open AP dos not automatically infer you are given the right for access. Furthermore, you may have no clue if the AP has client isolation active. If not, then you may have no idea who is stealing *your* information and files.
